This document is a working template based on standard South African consumer-retail and Section 21 cannabis-supply practice. It will be reviewed and signed off by a POPIA- and consumer-law-qualified attorney before public launch.
1. About these terms
These terms form a binding agreement between you and Cannabuben (Pty) Ltd regarding your use of cannabuben.co.za and the sale of products listed there. By placing an order you confirm you have read and accept these terms.
2. The service
Cannabuben is an online retailer of cannabis, CBD, hemp and related wellness products. Products fall into two categories:
- Non-prescription items (accessories, CBD products, etc.) — dispatched directly after payment.
- Prescription items (Schedule 4 / Schedule 6 / Section 21 cannabis medicines) — dispatched after clinical screening and, where required, SAHPRA Section 21 authorisation via a HPCSA-registered practitioner on our panel.
3. Eligibility
- You must be ordinarily resident in South Africa for delivery.
- You must be 18 years or older to purchase any product listed on this site.
- You must provide accurate information for age, ID, shipping, and clinical review.
4. Orders and payment
- Placing an order is an offer to buy. We confirm acceptance by dispatching the order.
- Payment is processed by PayFast (card / EFT) or via manual bank transfer.
- Prices are in South African Rand (ZAR) and include VAT where applicable.
- We reserve the right to cancel an order and refund you if stock is unavailable.
5. Prescription items — clinical screening
For orders that include a Schedule 4, Schedule 6, or Section 21 product we require a post-payment clinical screening. A HPCSA-registered practitioner reviews the case and decides whether to authorise dispatch. If the practitioner declines, you will receive a full refund for the declined item(s). If you do not complete the screening within 14 days of payment, the order may be cancelled and refunded.
6. Refunds and returns
- Non-prescription items: unopened and in original packaging may be returned within 7 days of delivery for a refund, subject to the Consumer Protection Act.
- Prescription items: once dispensed and delivered, returns are not accepted for health and safety reasons, except in the case of a product defect or incorrect dispensing.
- Declined / rejected orders: full refund processed within 5 business days.
7. Shipping and delivery
- Delivery nationwide in South Africa via our courier partners.
- Standard delivery 1–3 business days for in-stock non-prescription items; prescription items follow the clinical-review timeline.
- Delivery fees are calculated at checkout based on weight and destination.
- Free shipping on qualifying orders over R500.
8. Acceptable use
- You will provide truthful, accurate, and complete information.
- You will not impersonate another person.
- You will not resell, redistribute, or onwardly supply any prescription item.
- You will not attempt to bypass age or prescription controls.
9. Limitations of liability
To the maximum extent permitted by law:
- Clinical decisions on prescription items are the responsibility of the reviewing HPCSA practitioner. Liability for clinical outcomes lies with the practitioner and the dispensing pharmacy.
- Service availability is not guaranteed. We may suspend the service for maintenance or force-majeure events.
- We are not liable for indirect, incidental, consequential, or special damages arising from your use of the platform.
- Nothing in these terms limits liability for fraud, gross negligence, or matters that cannot be limited under the Consumer Protection Act, 2008.
10. Governing law and dispute resolution
These terms are governed by the laws of the Republic of South Africa. Disputes will first be addressed by good-faith mediation. If unresolved, the courts of the Western Cape Province will have exclusive jurisdiction. Nothing in this clause prevents either party from approaching the relevant regulator (HPCSA, SAHPRA, the Information Regulator, or the Consumer Goods and Services Ombud).
11. Changes to these terms
We may update these terms. Material changes are communicated by email at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance.
